Use this skill when the user asks about driver discipline — when to coach vs warn vs suspend vs terminate, progressive discipline frameworks, at-will employment in trucking, documenting violations, separating "willful violation" from "human error," and how to handle a driver who refuses corrective action. Reference state employment law + ATA SMP.

A safety culture punishes willful violations but learns from human errors. This requires a clear, consistent framework. This skill covers the practical playbook.
Progressive correction means escalating intervention proportional to severity + recurrence:
Level 1 — Coaching / Verbal Correction
Level 2 — Written Warning
Level 3 — Final Written Warning + Probation
Level 4 — Suspension (with or without pay)
Level 5 — Termination
NOT every issue starts at Level 1. Severe issues (DUI, accident-causing) can start at Level 4 or 5. Most issues should start lower + escalate if pattern emerges.
Most effective for behavior change. Structured approach:
Formal documentation of the issue + expectations:
Driver receives copy; original goes in DQF or HR file.
Indicates this is the last chance before suspension:
When written warnings haven't corrected behavior:
For trucking specifically, suspension has cost: driver loses pay, carrier loses capacity. Use carefully.
When other levels haven't corrected OR severity warrants immediate action:
Most US states are "at-will" — employer can terminate any time for any reason (or no reason), as long as not discriminatory or retaliatory.
Trucking specifics:
Right-to-fire DOES NOT mean smart-to-fire. Best practice: document progressive discipline.
For every disciplinary action:
Documentation that's vague or absent = lawsuit exposure.
A core distinction:
→ Discipline progressively, terminate at the right level
→ Coach + train + system improvement
The distinction matters legally (wrongful termination claims) + culturally (drivers learn vs hide).
Sometimes a driver:
Carrier options:
Don't escalate emotionally. Stay procedural. Document everything.
Even when warranted by behavior:
Consult HR or legal counsel for borderline cases.
When a driver is terminated for safety-related cause, this may appear on:
PSP entries do affect the driver's hireability at next carrier. Make sure terminations are documented accurately.
X3's dq-files.html includes a coaching + discipline log per driver. Documented coaching sessions + warnings tied to specific incidents. The scorecards.html flags drivers trending into discipline territory.
For sensitive disciplinary decisions:
A consistently-applied progressive discipline framework is one of the strongest safety culture signals.
