Defensive Driving Course Requirements

Federal law does NOT mandate defensive driving training for CMV drivers (except for entry-level ELDT requirements). State and carrier requirements vary widely.

What federal law requires (§ 391.11)

Driver must "possess the necessary skills to safely operate a CMV." This is a general qualification, not a course requirement. ELDT (49 CFR Part 380) requires 31 theory + 19 behind-the-wheel topics for first-time CDL applicants — but no recurring federal training.

State-level requirements

  • Some states (CA, OH, others) mandate defensive driving for renewal of certain CDL endorsements
  • Some states mandate accident-history-triggered training (driver had X+ accidents → required course)
  • Hazmat endorsement renewal may require security awareness training

Carrier-level requirements (most common)

  • New-hire orientation: typically 2-8 hours
  • Annual refresher: 1-4 hours (recommended, not required)
  • Post-accident review (if accidents occur)
  • Roadside-inspection-triggered: if BASIC alerts, supplemental training

Programs commonly used

  • Smith System — defensive driving methodology (5 keys to safety)
  • CarriersEdge — DOT-focused online courses
  • JJ Keller Encompass — full LMS with hundreds of DOT courses
  • Smith System certified instructor — at carrier or vendor
  • Various TPR-registered providers for ELDT

What auditors look for

  • Training records in employee file (not DQF)
  • Date completed, hours, instructor/vendor
  • Specific course/topic covered
  • Driver acknowledgment of completion

How Compass tracks

Compass Training module:

  • Course library imported from LMS vendors (Infinit-i, JJ Keller, etc.)
  • Per-driver completion tracking
  • Renewal alerts for required training
  • Audit-ready report exports

CFR citations

  • 49 CFR § 391.11
  • 49 CFR Part 380

How Compass surfaces this

Searchable in Compass Ask. Runs against carrier fleet data when invoked from the relevant tracker. Read-only; no actions without explicit user approval.
