Use when a driver has been involved in a crash — regardless of preventability or injury — and the carrier needs to handle the immediate, post-investigation, and return-to-work phases. Covers trauma response, post-accident testing under 49 CFR 382.303, paid time off, retraining, light duty, and re-entry planning.

A crash is a high-stress event for a driver, even with no injuries. How a carrier handles the next 30 days affects driver retention, safety culture, mental health, and legal exposure.
The driver's first job: get themselves and others safe. Then call 911 if injuries, then dispatch.
| Crash type | Test required? |
|---|---|
| Fatality (any) | YES — both alcohol within 8 hr; drug within 32 hr |
| Bodily injury treated away from scene + citation issued to driver | YES |
| Vehicle towed from scene + citation issued to driver | YES |
| Any other | NO |
If test required and not administered: driver cannot resume safety-sensitive duties until completed. Document why test was unavailable if not done.
If the driver is hospitalized, the carrier (with driver's permission or via emergency contact) calls family. Don't let family find out from social media.
A driver who's been in a serious crash often experiences:
Carrier response:
A serious crash — especially with fatality or significant injury — can trigger PTSD. ~15–25% of drivers in fatal-injury crashes develop PTSD symptoms.
Watch for:
Refer to EAP. Don't push return-to-driving until mental health professional clears.
| Status | Action |
|---|---|
| Driver medically cleared, no PTSD, preventable crash, minor | Coach + return to duty |
| Driver medically cleared, no PTSD, non-preventable | Return to duty, no discipline |
| Driver medically cleared, mild stress reaction | Phased return (light duty 1 week, then partner-driver 1 week, then solo) |
| Driver with PTSD symptoms | EAP + therapist + medical examiner re-evaluation before return |
| Driver with significant injury | Medical recovery first; reassess CDL fitness |
| Driver refusing to return | EAP + open conversation; not all drivers come back |
| Phase | Duration | Activity |
|---|---|---|
| Office support | 1–2 weeks | Dispatch shadow, paperwork help, low-stress |
| Local short-haul | 1–2 weeks | Daylight, familiar routes, home each night |
| Regional / partner driving | 1–2 weeks | Co-driver for buddy support |
| Full duty | Ongoing | Return to assigned lane |
Not all drivers need all phases. Some return full-duty next week. Some never return to driving.
If the crash had a clear behavioral driver (following distance, speeding, distraction), retraining before return is appropriate:
If injury, medication change, or mental-health concern, the medical examiner re-evaluates:
Driver cannot resume safety-sensitive duties until medical examiner clears. Document in DQF.
| Phase | Driver involvement |
|---|---|
| Initial report | Driver provides statement to insurance |
| Discovery | Driver may give recorded statement |
| Litigation | Driver may be deposed |
| Settlement / trial | Driver may testify |
Carrier supports driver throughout. Many drivers find litigation more traumatic than the crash itself. Carrier-funded attorney support helps.
A crash alone doesn't justify termination. Factors:
If terminated, document carefully:
Wrongful termination after a crash is a common driver suit. Documentation defends.
A driver who feels supported through a crash often becomes the most loyal employee on the roster. A driver who feels abandoned leaves and tells everyone.
